INTERNET BANKING SERVICES DISCLOSURE AND AGREEMENT
This Agreement between you and Feliciana Bank and Trust Company (“FBT ”) FBT governs the use of FBT’s Internet Banking Services. These services permit FBT customers to perform a number of banking functions on accounts linked to the service through the use of a personal computer. When you use any of the Internet Banking Services (“IBS”) described in this Agreement or authorize others to use them, you agree to the terms and conditions of the entire Agreement.
You or Your – The person(s) subscribing to or using Internet Banking
We, Us, or Our – Refers to FBT and any agent, designee, independent contractor or assignee FBT may involve in the provision of Internet Banking.
Business Day – Any calendar day other than Saturday, Sunday or any holidays recognized by FBT. Bill payments are processed on all business days that both the Federal Reserve and the US Postal System are operating and open for business.
Business Day Cut-Off – FBT main office is located at 10926 Plank Road, Clinton, Louisiana, and we base our business day on the Central Time zone. For posting purposes, we will process all on-line transactions completed by 6:30 p.m. on that business day. Transactions completed after 6:30 p.m., will be processed on the following business day.
Electronic funds transfers – include deposits to, withdrawals from or transfers between your accounts which are not originated by check, draft or similar paper instrument. Electronic transfers include those made through a computer. If we authorize your account(s) for electronic transfers through the IBS, you have certain rights and responsibilities under the Electronic Funds Transfer Act (EFT) which are further detailed in this Agreement.

We have taken steps to protect the security and privacy of your personal information and as well as your financial transactions with us. Your Access ID and Password
Each individual who requests access to FBT Internet Banking Services, including each individual named on joint accounts must complete an application. At the time you request Internet Banking, you may select a unique “Access ID” and we will choose a first time log-on Password. Prior to activation, the IBS department will verify your identity and authorization to information associated with the account(s) that you request to be tied to the service. Your password must contain at least 4 alpha characters, with 1 character in uppercase, 1 numeric characters, 1 special character(ex.*$&#) and be between 8 and 17 characters in length. When you log-in to the system as a First Time User you must use your temporary password assigned to you by FBT. You will be required at that time to change your password to one of your choosing. We reserve the right to require periodic password changes and establish limits on re-use of passwords. To guard against unauthorized use of your Access ID and Password, FBT disables the password on the third incorrect attempt to log-in. The disabling of the password keeps an unauthorized agent from attempting to guess a password. This will occur if you accidentally activate this security feature by unintentionally miss-keying a password three times. You will need to call FBT to reestablish the password for your account(s). At that time, your password will be reset to your original temporary password.
A common mistake made by users is leaving the caps-lock on while keying in an access ID and password. Since the access ID and password are case sensitive and you cannot actually see the password characters you are typing, it is easy to think you are typing the password correctly.
Your use of IBS may also be affected by the agreements between us for your FBT accounts. When you link an account to IBS, you do not change the agreements you already have with us for that account. You should review those agreements for any applicable fees, for limitations on the number of transactions you can make, and for other restrictions that might impact your use of an account with IBS. Some of the above services may not be available for certain accounts or customers. We may change these tools and services or add new ones without advance notice. You may request Internet access to any account that you are a signer or owner. If you desire services that allow you to initiate payments or transfers from the account, you will need the required withdrawal authority over the account to be able to complete the transaction.
Internet Banking Service is available to our consumer and business customers at no monthly charge for all account information services and transfers.
You are responsible for the accuracy of all information you input. You will comply with any instructions or conditions for use of the services and tools as set forth within Internet Banking Service.
You authorize FBT to withdraw, debit or charge the necessary funds from your designated FBT account on the delivery or transfer date you designate. You agree that you will instruct us to make a withdrawal only when a sufficient balance is or will be available in your account(s) at the time of the withdrawal. The completion of a transfer or payment is subject to the availability of sufficient funds (including any overdraft protection plans) at the time the transaction is posted. If enough funds to complete the transfer or payment are not available, we may either (i) complete the transaction and overdraw the account or (ii) refuse to complete the transaction. In either case, we may charge a non-sufficient funds (NSF), returned item, overdraft, or similar fee. Please refer to the applicable account agreement and fee schedule for details. At our option, we may make a further attempt to issue the payment or process the transfer request. FBT is under no obligation to inform you if it does not complete a payment or transfer because there are non-sufficient funds or credit in your account to process the transaction. In this case, you are responsible for making alternate arrangements or rescheduling the payment or transfer within IBS.
Transfers made through IBS from a savings or money market account may result in an excess transaction fee. See your savings or money market account product and services agreement. An NSF-fee returned item, overdraft or similar fee may also apply if you schedule payments or transfers and your available balance is not sufficient to process the transaction on the date scheduled. We may charge you a research fee of $20.00 per hour for an inquiry about a transaction that occurred more than 180 days before the date you make the inquiry. This fee will be waived if we determine that a bank error occurred.
Internet Banking Services are available 365 days a year and 24 hours a day, except during system maintenance and upgrades. For IBS, our business days are Monday through Friday, excluding bank holidays. FBT is not responsible for any transfer not made during any computer system or software maintenance, upgrade or failure.
We may change this agreement at any time. For example, we may add, delete or amend terms or services. We will notify you of such changes by mail or printed bank statement inserts. If you initiate any transfer of funds or bill payment through your IBS or make any Transfers Outside FBT after the effective date of a change, you indicate your agreement to the change.
Federal regulations limit the number of preauthorized electronic fund transfers and telephone transfers - including Online Banking transactions - from money market checking and savings accounts. You are limited to six (6) preauthorized electronic fund transfers, telephone transfers, checks and point-of-sale transactions per statement cycle. Of these six (6) transactions, you are limited to only three (3) transactions by check or point-of-sale. (For information on these accounts, see the applicable account agreement.) Each transfer or payment through the IBS from your money market account is counted as one of the six (6) limited transfers you’re permitted each statement period. We charge a fee for each transaction in excess of this limit. Payments to your FBT loans are counted toward this limit for money market accounts. We recommend that you not use a money market account as your BillPay account because of these restrictions.
No Feliciana Bank employee or Payee employee, nor any company affiliated with FBT Internet Banking Services will contact you via email or phone requesting your Access ID or IBS Password. If you are contacted by anyone requesting this information, please contact us immediately.
Canceling or Changing Transfers
To stop recurring transfers made only thru Internet Banking Services between your FBT accounts, you must log in and make edits to pending transfers. You must make edits before our cut-off time 6:30 p.m. CST for any transfers scheduled to be processed that business day. Up to that time, you may go into any pending payment and revise the amount (change to $0.00 to cancel) or payment information. You cannot cancel or edit a transfer once it has been approved, unless it has been prescheduled – in which case you have until our cut-off time 6:30 p.m. CST to cancel or edit the transfer instruction. If you accidentally transferred funds, simply schedule another transfer to move funds back to the original account.
Cancellation of Internet Banking Services
Your Internet Banking Services will remain in effect until it is terminated by you or Feliciana Bank. We may terminate your participation in IBS for any reason, including inactivity, at any time. We will try to notify you in advance, but we are not obliged to do so. You will remain responsible for all transactions approved by the system prior to the cancellation, and for any other fees associated with the service. You may cancel your service at any time by notifying us of your intent to cancel in writing, through hand delivery to one of our branches, or by calling Internet Banking Service at 225-683-8565. This cancellation applies to your IBS and does not terminate your FBT accounts. We recommend that you cancel any scheduled payments prior to notifying us that you are discontinuing the service.
If you choose to cancel your IBS, any unprocessed payments will be canceled. We recommend that you cancel any scheduled payments prior to notifying us that you are discontinuing the service. FBT will cancel your IBS within two (2) bank business days from the date we receive your request to discontinue the service. If you close your primary checking account, or if it’s no longer linked to your service, your IBS will end, and any unprocessed payments will be canceled.
Responsibilities and Liability for Unauthorized Use
FBT recommends that you should not share your personal Access ID and Password with anyone. When you give someone your Internet Banking Access ID and Password, you are responsible for all transactions performed. If you notify us that person is no longer authorized, then only transactions that person performs after the time you notify us are considered unauthorized. Transactions that you or someone acting with you initiates with fraudulent intent are also authorized transactions.
You agree to contact FBT at once if you believe your Internet Banking/BillPay password has been lost, stolen or money is missing from your account(s). Telephoning is the best way to control your loss although you must confirm notice of unauthorized use in writing. Our liability, if any, to restore any stolen funds shall be governed by Federal and Louisiana State Law, and your other account agreements. Call us immediately at the following number: 225-683-8565. You must contact FBT no later than sixty (60) days after we send you the FIRST statement on which the problem or error appeared. You must provide the following information: name and account number; description of the error you are unsure about and why you believe it is an error or why you need more information; the dollar amount of the suspected error. If you telephone us, you must also send us your complaint in writing within ten (10) business days. We will determine whether an error occurred within 10 business days after we hear from you and will correct any error promptly. We may extend the time frame for investigation to 20 business days on a new account, if the suspected error occurred outside the United States or if it occurred at a merchant location for the purchase of goods and services. If we need more time, however, we may take up to 45 days to investigate your complaint or question. We may extend the investigation up to 90 days if on a new account, if the suspected error occurred outside the United States, or if it occurred at a merchant location for the purchase of goods or services. If we decide to do this, we will provisionally credit your account within 10 business days for the amount you think is in error, so that you will have the use of your money during the time it takes us to complete our investigation. We will provide provisional credit within 20 business days if a new account, if the suspected error occurred outside the United States, or if it occurred at a merchant location for the purchase of goods or services. If we ask you to put your complaint or question in writing and we do not receive it within ten business days, we may not provisionally credit your account. We will tell you the results within 3 business days after completing our investigation. If we determine that there was no error, we will send you a written explanation. You may ask for copies of the documents that we used in our investigation.
You could lose all the money in your account (plus your maximum limit of funds from your overdraft protection account) if applicable. If you tell us within 2 business days after you learn that your access ID and password have been compromised, lost or stolen, you can lose no more than $50.00 if someone used your password without your permission. If you do not tell us within 2 business days, after you learn of the loss or theft of your password and we can prove we could have stopped someone from using your access ID, password without your permission if you had told us, you could lose as much as $500.00.

Errors and Questions
In cases of errors or questions concerning transactions completed within the IBS, do one of the following as soon as possible. Please include the following information:
Disclosure of Account Information to Third Parties
We may disclose information to third parties about you or your account or your transactions in the following instances: When it’s necessary for completing transfers or bill payments, or to investigate or resolve a problem related to a transfer or payment; To verify the existence and condition of your account for a third party, such as a credit bureau or merchant; To comply with a government agency or court orders, or in connection with fraud prevention or an investigation; If you give us your permission; With our affiliates as permitted under Federal and applicable state laws; or on a closed account, if we reasonably believe you have mishandled it.
By using IBS, you acknowledge and agree that this Agreement sets forth security procedures for electronic banking transactions that are commercially reasonable. You agree to be bound by instructions, whether authorized or unauthorized, which we implement in compliance with these procedures, unless you have given us prior notice of possible unauthorized use as described above (and we had a reasonable opportunity to act on such notice).
Our Liability for Failure to make Transfers
If we fail or delay in making a payment or transfer pursuant to your instructions, or if we make a payment or transfer in an erroneous amount that is less than the amount per your instructions, unless otherwise required by law, our liability shall be limited to interest on the amount that we failed to timely pay or transfer, calculated from the date on which the payment or transfer was to be made until the date it was actually made or you canceled the instructions. We may pay such interest either to you or the intended recipient of the payment or transfer, but in no event will we be liable to both parties, and our payment to either party will fully discharge any obligation to the other. If we make a payment or transfer in an erroneous amount that exceeds the amount per your instructions, or if we permit an unauthorized payment or transfer after we have had a reasonable time to act on a notice from you of possible unauthorized use as described above, unless otherwise required by law, our liability will be limited to a refund of the amount erroneously paid or transferred, plus interest thereon from the date of the payment or transfer to the date of the refund, but in no event to exceed 60 days’ interest. If we become liable to you for interest compensation under this Agreement or applicable law, such interest shall be calculated based on the average federal funds rate at the Federal Reserve Bank in the district where FBT is headquartered for each day interest is due, computed on the basis of a 360-day year. Unless otherwise required by law, in no event will FBT be liable to you for special, indirect or consequential damages including, without limitation, lost profits or attorney’s fees, even if we are advised in advance of the possibility of such damages.
In no event shall we be liable for damages in excess of your actual loss due to our failure to complete a transfer, and we will not be liable for any incidental, special, or consequential damages. There may be other exceptions stated in our deposit account agreements with you. We do not assume any liability or warranty or otherwise guarantee the security of information in transit to or from us.
